Cal. Civ. Code § 32-31-1-18
Death of life tenant demising land; recovery of rent
Operative Text
Sec. 18. If a life tenant who has demised any lands dies on or after the day on which rent is due and payable, the executor or administrator of the life tenant's estate may recover from the under tenant the whole rent due. If the life tenant dies before the day on which rent is due: (1) the executor or administrator of the life tenant's estate may recover the proportion of rent that accrued before; and (2) the remainderman may recover the proportion of rent that accrued after; the life tenant's death.
Indiana Code § 32-31-1-18 governs what happens to rent obligations when a life tenant landlord dies. If the life tenant dies on or after the rent due date, the full rent for that period goes to the life tenant's estate. If the life tenant dies before rent comes due, the rent is split: the estate collects the share that built up before the death, and the remainderman—the person who inherits the property interest after the life tenancy ends—collects the share that accrued afterward.

Property managers and estate representatives handling a deceased life tenant's affairs should be aware that Ind. Code § 32-31-1-18 determines who is entitled to collect rent from under tenants. The executor or administrator of the estate is generally responsible for pursuing rent that accrued up to and including the date of death, while coordinating with the remainderman regarding any post-death accruals. Keeping clear records of rent accrual periods and the exact date of the life tenant's death helps ensure that rent is properly allocated between the estate and the remainderman.

Under Ind. Code § 32-31-1-18, tenants renting from a life tenant may find themselves owing rent to two different parties if the life tenant dies before the rent due date—the estate for the pre-death portion and the remainderman for the post-death portion. Tenants in this situation have a right to understand who holds a valid claim to each portion of rent before making payment. Consulting a tenant-rights organization or legal aid service can help clarify which party is authorized to receive payment and whether any documentation should be requested before remitting funds.
