Cal. Civ. Code § 32-31-1-4
Notice; determination of tenancy
Operative Text
Sec. 4. (a) This section applies to a tenancy of not more than three (3) months which, by express or implied agreement of the parties, extends from one (1) period to another. (b) Notice to the tenant equal to the interval between the periods is sufficient to determine a tenancy described in subsection (a).
Indiana Code § 32-31-1-4 addresses how a short-term periodic tenancy—one lasting three months or less that automatically renews from period to period—can be brought to an end. Under this provision, either party can terminate such a tenancy by giving the other party notice that is at least as long as the interval between rental periods. For example, a month-to-month tenancy of this type would require one month's notice, while a week-to-week tenancy would require one week's notice.
Plain English — not legal advice.
Under Ind. Code § 32-31-1-4, operators managing short-term periodic tenancies of three months or less should ensure that any termination notice matches the length of the rental period—no more, no less is required by this rule. Compliant operators typically document the notice in writing and deliver it in a manner that creates a clear record of when it was given. Keeping records of the tenancy's agreed-upon period and the timing of any notice helps demonstrate compliance with this provision.

Ind. Code § 32-31-1-4 establishes that tenants in short-term periodic tenancies of three months or less are entitled to receive termination notice equal to the length of their rental period before a landlord can end the tenancy. If a tenant believes they did not receive adequate notice under this provision, that may be raised as a defense in any eviction or possession proceeding. Tenants seeking to understand their rights under this rule may wish to consult a local tenant-rights organization or legal aid office for general information.
