Indiana Code § 32-31-10-6 governs how COVID-19 federal rental assistance funds are distributed in Indiana. It required the Indiana Housing and Community Development Authority and qualifying political subdivisions to establish a separate landlord-initiated application pathway by August 31, 2022, alongside the existing tenant application process. Critically, any landlord-submitted application under this pathway must carry the tenant's signature and certification before it can be considered valid.

For Property Managers

Under Ind. Code § 32-31-10-6, landlords seeking COVID-19 federal rental assistance funds through the designated landlord application process are generally expected to obtain the tenant's signature and certification on any application they submit. Compliant operators typically coordinate with their tenants early in the process to secure that required sign-off, since an unsigned application does not meet the statutory standard. Landlords working with the Indiana Housing and Community Development Authority or a local political subdivision should confirm that the designated landlord application pathway was made available by the August 31, 2022 deadline.

For Tenants

Ind. Code § 32-31-10-6 gives tenants a meaningful role in the COVID-19 rental assistance process: a landlord cannot submit a designated landlord application for federal rental assistance funds without the tenant's signature and certification. This means tenants have the opportunity to review and affirm any application a landlord files on their behalf before it is submitted. Tenants who have questions about whether an application was properly certified, or who believe their rights under this provision were not respected, may wish to contact the Indiana Housing and Community Development Authority, a local tenant-rights organization, or a legal aid provider for general information.
