Cal. Civ. Code § 32-31-11-2
Applicability of definitions; "eviction action"
Operative Text
Sec. 2. For purposes of this chapter: (1) the definitions in IC 32-31-3 apply; and (2) "eviction action" means: (A) an action for possession of the rental premises (as defined in IC 32-31-7-3), including a petition for an emergency possessory order under IC 32-31-6; or (B) an action to evict the tenant from the rental premises (as defined in IC 32-31-7-3); as authorized by the rental agreement or by any applicable law.
Indiana Code § 32-31-11-2 establishes the vocabulary used throughout Chapter 11 of Indiana's landlord-tenant law. It imports definitions from IC 32-31-3 and specifies that an 'eviction action' covers two types of legal proceedings: a lawsuit to regain possession of rental premises (including emergency possessory petitions under IC 32-31-6) and a lawsuit to remove a tenant from rental premises. Both types of proceedings must be authorized either by the rental agreement or by applicable law.

Under Ind. Code § 32-31-11-2, any legal proceeding a property owner initiates to reclaim possession of a rental unit or to remove a tenant qualifies as an 'eviction action' for purposes of Chapter 11. Compliant operators generally ensure that any such action is grounded in the rental agreement or in applicable Indiana law, as the statute requires. Familiarity with the cross-referenced definitions in IC 32-31-3 and IC 32-31-7-3 helps operators understand the full scope of what the chapter governs.

Ind. Code § 32-31-11-2 defines what counts as an 'eviction action' under Indiana law, which includes both a landlord's lawsuit for possession and a lawsuit to remove a tenant from the premises. Understanding this definition matters because the protections and procedures in Chapter 11 apply whenever a landlord initiates either type of proceeding. Tenants who believe an eviction action has been filed against them may wish to review the related provisions in IC 32-31-3 and IC 32-31-7-3, or consult a tenant-rights organization to understand how these definitions affect their situation.
