Cal. Civ. Code § 32-31-3-1.1
Validity of certain rental agreements
Operative Text
Sec. 1.1. Rental agreements entered into before July 1, 1989, remain valid and may be terminated, completed, consummated, or enforced as though this chapter had not been enacted.
Indiana Code § 32-31-3-1.1 establishes that rental agreements created before July 1, 1989, retain their legal validity under the terms that existed when they were formed. These older agreements are not invalidated by the enactment of the chapter in which this provision appears, and they may continue to be carried out, concluded, or enforced according to their original terms. In effect, the law creates a grandfather clause protecting pre-1989 rental agreements from being disrupted by later statutory changes.

Under Ind. Code § 32-31-3-1.1, property owners who entered into rental agreements before July 1, 1989, can generally continue to operate under those agreements' original terms without concern that the subsequently enacted chapter renders them void. Compliant operators typically maintain records of the original agreement dates and terms to demonstrate the agreement's pre-1989 status if questions arise. Understanding which statutory framework governs a given tenancy is an important part of managing older rental properties in Indiana.

Ind. Code § 32-31-3-1.1 means that if a tenant's rental agreement was signed before July 1, 1989, that agreement remains legally valid and enforceable on its original terms, even though Indiana later enacted new rental regulations. Tenants in this situation retain the rights and protections that existed under their original agreement, and those terms can still be raised in any dispute over the tenancy. Tenants with questions about how this grandfather provision applies to their older agreement may wish to consult a tenant-rights organization or legal aid service familiar with Indiana landlord-tenant law.
