Cal. Civ. Code § 32-31-6-6
Emergency order
Operative Text
Sec. 6. (a) At the emergency hearing, if the court finds: (1) by a preponderance of the evidence that the landlord has violated or threatened to violate IC 32-31-5-6; and (2) that the tenant will suffer immediate and serious injury, loss, or damage; the court shall issue an emergency order under subsection (b). (b) If the court makes a finding under subsection (a), the court shall order the landlord to do either or both of the following: (1) Return possession of the dwelling unit to the tenant if the tenant has been deprived of possession of the dwelling unit. (2) Refrain from violating IC 32-31-5-6. (c) The court may make other orders that the court considers just under the circumstances, including setting a subsequent hearing at the request of a party to adjudicate related claims between the parties.
Indiana Code § 32-31-6-6 establishes the conditions under which a court may issue an emergency order at an emergency hearing in a landlord-tenant dispute. If the court finds, by a preponderance of the evidence, that a landlord has violated or threatened to violate IC 32-31-5-6 and that the tenant faces immediate and serious harm, the court must order the landlord to restore the tenant's possession of the dwelling unit, stop the violating conduct, or both. The court may also issue additional orders it deems fair under the circumstances, including scheduling further hearings to resolve related claims between the parties.

Under Ind. Code § 32-31-6-6, a landlord who is found at an emergency hearing to have violated or threatened to violate IC 32-31-5-6 faces a mandatory court order requiring restoration of the tenant's possession of the unit, cessation of the prohibited conduct, or both. Operators who maintain compliance with IC 32-31-5-6 and avoid actions that could deprive tenants of possession generally reduce their exposure to emergency judicial intervention. Property managers should be aware that the court retains broad discretion under § 32-31-6-6(c) to craft additional remedies and to schedule follow-up hearings on related claims.

Ind. Code § 32-31-6-6 gives tenants a path to seek emergency court relief when a landlord has violated or threatened to violate IC 32-31-5-6 and the tenant faces immediate and serious injury, loss, or damage. If those findings are made at an emergency hearing, the court is required to order the landlord to return possession of the dwelling unit, stop the violating conduct, or both. Tenants who believe they qualify for this protection may wish to consult a tenant-rights organization or legal aid provider to understand the process for requesting an emergency hearing under § 32-31-6-6.
