Cal. Civ. Code § 32-31-6-8
Summons; court procedure
Operative Text
Sec. 8. (a) If a petition is filed under this chapter, the clerk shall issue to the respondent a summons to appear at a hearing. The summons must: (1) give notice of the date, time, and place of the hearing; and (2) inform the respondent that the respondent must appear before the court to answer the petition. (b) The clerk shall serve the respondent with the summons to appear in accordance with Rule 4.1 of the Rules of Trial Procedure. (c) The court shall not grant a continuance of the emergency hearing except upon clear and convincing evidence that manifest injustice would result if a continuance were not granted.
Indiana Code § 32-31-6-8 governs the procedural steps that follow the filing of a petition under this chapter of Indiana's landlord-tenant law. Once a petition is filed, the court clerk is required to issue a summons to the respondent that specifies the hearing's date, time, and place and notifies the respondent of their obligation to appear. The provision also sharply limits the court's ability to postpone the emergency hearing, allowing a continuance only when clear and convincing evidence shows that a manifest injustice would otherwise occur.

Property owners or managers who are named as respondents in a petition filed under Ind. Code § 32-31-6-8 can expect to receive a formal summons served in accordance with Indiana Rule of Trial Procedure 4.1. Compliant operators generally maintain current contact and address information so that service of process reaches the right person without delay. Because the statute sets a very high bar for postponing the emergency hearing, operators typically prepare to respond promptly once a summons is received.

Under Ind. Code § 32-31-6-8, a tenant who files a petition under this chapter is entitled to have the court clerk issue a summons to the other party and schedule a hearing. The strict standard for granting continuances means the emergency hearing is generally expected to proceed on the scheduled date, which can benefit tenants seeking timely resolution. Tenants who have questions about the petition process or their rights at the hearing may wish to consult a local tenant-rights organization or legal aid office for general guidance.
