Cal. Civ. Code § 32-31-8-1
Application
Operative Text
Sec. 1. (a) Except as provided in subsection (b), this chapter applies only to dwelling units that are let for rent under a rental agreement entered into after June 30, 2002. (b) This chapter does not apply to dwelling units that are let for rent with an option to purchase under an agreement entered into before July 1, 2008.
Indiana Code § 32-31-8-1 defines the scope of the tenant-landlord protections contained in this chapter. As a general rule, the chapter's provisions apply to residential rental units covered by rental agreements entered into after June 30, 2002. However, rent-to-own arrangements—dwelling units rented with an option to purchase—are carved out of the chapter's coverage if the underlying agreement was entered into before July 1, 2008.

Under Ind. Code § 32-31-8-1, property owners and managers should be aware that the obligations set out in this chapter attach to rental agreements signed on or after July 1, 2002. Operators who entered into rent-with-option-to-purchase agreements before July 1, 2008 generally fall outside this chapter's requirements for those specific units. Compliant operators typically review the date and type of each rental agreement in their portfolio to determine whether this chapter's rules apply.

Ind. Code § 32-31-8-1 determines whether the protections in this chapter are available to a given renter. Tenants whose rental agreements were signed after June 30, 2002 are generally covered, while those in rent-to-own arrangements predating July 1, 2008 may not be. Renters who are uncertain whether their agreement falls within this chapter's scope may benefit from consulting a tenant-rights organization or legal aid provider familiar with Indiana housing law.
