Cal. Civ. Code § 32-31-8-3
"Rental premises" defined
Operative Text
Sec. 3. As used in this chapter, "rental premises" includes all of the following: (1) A tenant's rental unit. (2) The structure in which the tenant's rental unit is a part.
Indiana Code § 32-31-8-3 establishes what the term "rental premises" means for the purposes of the chapter in which it appears. The definition is intentionally broad, covering not just the individual unit a tenant occupies but also the larger building or structure that contains that unit. This scope matters because rights, duties, and standards described elsewhere in the chapter apply to both of those physical spaces.
Plain English — not legal advice.
Under Ind. Code § 32-31-8-3, a landlord's obligations and responsibilities that reference "rental premises" extend beyond the walls of an individual apartment or unit. Compliant operators generally account for the condition and management of the entire building or structure when evaluating their duties under this chapter, not just the space directly leased to a given tenant. Keeping common areas, shared systems, and the broader structure in mind is consistent with how this definition frames the scope of the chapter.

Ind. Code § 32-31-8-3 means that when this chapter grants tenants rights or protections related to "rental premises," those protections can extend to the whole building or structure — not only the specific unit being rented. Tenants who believe conditions in shared or common areas of the building are relevant to a dispute or complaint may find that this broad definition supports their position. Tenant-rights organizations or legal aid services can help explain how this definition interacts with other provisions in the chapter.
