Cal. Civ. Code § 36-1-24-1
Applicability
Operative Text
Sec. 1. (a) This chapter does not apply to a unit that has adopted a zoning ordinance or any other ordinance before January 1, 2018, that prohibits, regulates, or restricts short term rentals in any manner. (b) Any reference in this chapter (except for this section) to a zoning ordinance or other ordinance does not apply to a zoning ordinance or other ordinance of a unit described in subsection (a). (c) A unit may amend or delete any provision of an ordinance described in subsection (a) after December 31, 2017, without complying with or becoming subject to this chapter. (d) A unit may repeal an ordinance described in subsection (a). However, in repealing the ordinance, the unit concurrently becomes subject to this chapter.
Indiana Code § 36-1-24-1 establishes which local governments are covered by the state's short-term rental chapter and which are not. Local units of government that had an ordinance in place before January 1, 2018, that addressed short-term rentals in any way are exempt from the chapter's requirements. Those exempt units can modify or remove their pre-existing ordinances freely, but if they fully repeal such an ordinance, they automatically become subject to the state chapter going forward.
Plain English — not legal advice.
Under Ind. Code § 36-1-24-1, whether the state's short-term rental chapter governs a property depends on the local unit of government's ordinance history. Operators generally verify whether their municipality had a qualifying pre-2018 short-term rental ordinance, because that determines which regulatory framework—local or state—applies to their rental activity. Staying current on any local ordinance amendments or repeals is a standard part of compliance monitoring, since a repeal triggers the unit's entry into the state chapter.

Ind. Code § 36-1-24-1 determines which legal framework governs short-term rentals in a given locality, which can affect what protections or restrictions apply in a tenant's or neighbor's community. Tenants and residents can check with their local government clerk or planning department to learn whether their municipality had a qualifying pre-2018 ordinance and whether it remains in effect, has been amended, or has been repealed. Tenant-rights organizations and local housing agencies can help residents understand how this applicability provision interacts with any local rules that may still be in force.
