Cal. Civ. Code § 36-1-24-15
Notice and hearing procedures for revocation
Operative Text
Sec. 15. If a unit revokes a permit under this chapter, revocation of the permit shall be conducted under the notice and hearing procedures of the unit for revocation of other permits issued by the unit.
Indiana Code § 36-1-24-15 establishes that when a local governmental unit revokes a rental permit under this chapter, the revocation process must follow the same notice and hearing procedures that the unit already uses for revoking other types of permits it issues. This means the rental permit holder is entitled to the same procedural protections—such as advance notice and an opportunity to be heard—that apply to any other permit revocation by that unit. The rule ensures consistency in how local governments handle permit revocations rather than creating a separate or lesser process for rental permits.

Under Ind. Code § 36-1-24-15, a property owner whose rental permit is subject to revocation is entitled to the same procedural steps the local governmental unit applies when revoking any other permit. Compliant operators generally stay informed about their unit's standard permit revocation procedures—including required notice timelines and hearing rights—so they understand what to expect if a revocation action is initiated. Reviewing the local unit's general permit ordinances or administrative rules can help a property owner understand the full scope of procedural protections available under this provision.

Ind. Code § 36-1-24-15 means that if a landlord's rental permit is being revoked, the local governmental unit must follow its standard notice and hearing procedures, providing the permit holder a formal opportunity to respond before revocation is finalized. Tenants in an affected property may want to monitor the status of their building's rental permit through the local governmental unit, as a revocation can have implications for the property's legal rental status. Tenant-rights organizations or local housing agencies can help residents understand how a permit revocation proceeding in their area might affect their housing situation.
