Sec. 27. (a) A person who has been issued and has
received notice of an order relative to unsafe premises and has not
complied with that order:

(1) must supply full information regarding the order to a person

(2) must, within five (5) days after transferring or agreeing to

(B) the legal instrument under which the transfer or agreement to

Plain English

Indiana Code § 36-7-9-27 governs what happens when a property owner who has received an unsafe-premises order attempts to transfer ownership or another substantial interest in that property without first complying with the order. The rule requires that the non-complying owner fully disclose the existence of the order to any incoming buyer or interest-holder before the transfer occurs, and then notify the enforcement authority in writing within five days of the transfer with the new party's contact information and the relevant legal instrument. Additionally, if a government entity later faces a court judgment because it failed to notify interested parties—and that failure traces back to the original owner's non-disclosure—the original owner can be held financially liable for the full amount of that judgment.

For Property Managers

Property owners and managers operating under Ind. Code § 36-7-9-27 should understand that an outstanding unsafe-premises order does not disappear upon a sale or transfer of interest. Compliant operators generally ensure that any prospective buyer, lessee, or other party acquiring a substantial property interest receives complete information about any open order before the deal closes. Within five days of completing such a transfer, compliant operators also provide the enforcement authority with written notice that includes the new party's full name, address, phone number, and a copy of the legal instrument effecting the transfer—and they retain documentation showing both disclosures were made.

For Tenants

If you are considering acquiring a rental unit or any substantial property interest in Indiana, Ind. Code § 36-7-9-27 gives you the right to receive full disclosure of any outstanding unsafe-premises order from the current owner before the transfer is finalized. If a seller or transferor withholds that information, they may be in violation of this provision, which could have consequences for the enforcement authority's ability to protect your interests going forward. Tenants and prospective buyers who believe a disclosure was withheld may consider contacting the local enforcement authority, reaching out to a tenant-rights organization, or consulting an attorney to understand what remedies may be available.
