Under Indiana Code §§ 5-20-3-7, 5-20-3-9, 5-20-4-12, and 5-20-9-6, residents of a mutual housing association are subject to three core requirements: they must actively participate in the ongoing operation and management of the housing community, they hold a protected right to remain in their home as long as they comply with their occupancy agreement, and they are prohibited from holding any equity or ownership stake in the property itself. This structure distinguishes mutual housing associations from traditional ownership or standard rental arrangements. The provision balances resident stability with a collective, non-equity model of housing.

For Property Managers

Operators and managers of mutual housing associations governed by Ind. Code §§ 5-20-3-7, 5-20-3-9, 5-20-4-12, and 5-20-9-6 generally structure their occupancy agreements to reflect all three resident obligations: participation in management, continued-residency rights tied to agreement compliance, and the prohibition on equity or ownership interests. Compliant associations typically establish clear participation requirements in their governing documents and occupancy agreements so that residents understand their roles and responsibilities. Occupancy agreements in these associations are also generally drafted to affirm that a resident's right to remain is conditioned on compliance, rather than on any ownership claim.

For Tenants

Residents of a mutual housing association in Indiana have a legally recognized right under Ind. Code §§ 5-20-3-7, 5-20-3-9, 5-20-4-12, and 5-20-9-6 to continue living in their home as long as they comply with the terms of their occupancy agreement, which provides meaningful housing stability. At the same time, this provision requires residents to participate in the ongoing operation and management of the association, and it makes clear that no equity or ownership interest in the property can be held. Residents who believe their continued-residency rights are being improperly challenged may wish to review their occupancy agreement, consult a tenant-rights organization familiar with Indiana housing law, or explore whether a complaint or legal defense is appropriate for their circumstances.
