The department shall adopt rules, pursuant to chapter 17A, regarding the: 1. Implementation of the grant program pursuant to section 135.103. 2. The department shall make the model regulations available to local boards of health and shall promote the adoption of the regulations at the local level, in cities and counties implementing lead hazard remediation programs. Iowa Code § 135.102 directs the Iowa Department of Public Health to establish administrative rules governing several aspects of childhood lead poisoning prevention. These rules cover areas such as grant program administration, laboratory maintenance, acceptable blood lead levels in children in targeted rental housing, and standards for lead hazard remediation. The provision also requires the department to develop model regulations for local boards of health to use when a child is confirmed lead-poisoned, though local adoption of those model regulations is not mandated.

Under Iowa Code § 135.102, landlords who own or manage targeted rental dwelling units should be aware that the Iowa Department of Public Health has rulemaking authority over lead hazard remediation standards that may apply when a child in their property is confirmed lead-poisoned. Compliant operators generally stay informed about the department's model regulations for lead hazard remediation, which are made available to local boards of health and may be adopted at the city or county level. Operators with properties in jurisdictions that have adopted local lead hazard remediation programs should familiarize themselves with any locally enacted rules derived from the department's model regulations.
