Iowa Code ch. 425 § 425.34
Rent increase hearings and appeals
Operative Text
1. If the department of health and human services orders a landlord to reduce rent to a claimant, then upon the request of the landlord the department of health and human services shall hold a prompt hearing of the matter, to be conducted in accordance with the rules of the department. The department of health and human services shall give notice of the decision by mail to the claimant and to the landlord. 2. The claimant and the landlord shall have the rights of appeal and review as provided in section 425.31.
Iowa Code ch. 425 § 425.34 establishes a two-step process when the Iowa Department of Health and Human Services orders a landlord to reduce rent for a claimant. First, the landlord may request a prompt hearing before the department, which is conducted under the department's own procedural rules, and both parties receive written notice of the resulting decision by mail. Second, both the claimant and the landlord retain the right to appeal and seek further review of any decision, following the procedures set out in section 425.31.

Under Iowa Code ch. 425 § 425.34, a landlord who receives a department order to reduce rent has the right to request a prompt hearing before the Iowa Department of Health and Human Services rather than being bound immediately by that order. Compliant operators generally submit a timely hearing request, participate in the proceeding according to the department's rules, and monitor the mailed notice of decision to determine whether further appeal under section 425.31 may be warranted. Keeping organized records of all correspondence with the department supports participation in both the hearing and any subsequent review process.

Iowa Code ch. 425 § 425.34 gives claimants a stake in any hearing that a landlord requests after the Iowa Department of Health and Human Services orders a rent reduction, and the department is required to notify the claimant by mail of the outcome. Claimants also hold independent appeal and review rights under section 425.31, meaning a tenant is not without recourse if the hearing decision is unfavorable. Tenants who receive a department notice or learn that a landlord has requested a hearing may wish to consult a tenant-rights organization or legal aid provider to understand the available options under this provision.
