Iowa Code ch. 562A § 562A.17
Tenant to maintain dwelling unit
Operative Text
The tenant shall: 1. Comply with all obligations primarily imposed upon tenants by applicable provisions of building and housing codes materially affecting health and safety. 2. Keep that part of the premises that the tenant occupies and uses as clean and safe as the condition of the premises permit. 3. Dispose from the tenant’s dwelling unit all ashes, rubbish, garbage, and other waste in a clean and safe manner. 4. Keep all plumbing fixtures in the dwelling unit or used by the tenant as clean as their condition permits. 5. Use in a reasonable manner all electrical, plumbing, sanitary, heating, ventilating, air-conditioning and other facilities and appliances including elevators in the premises. 6. Not deliberately or negligently destroy, deface, damage, impair or remove a part of the premises or knowingly permit a person to do so. If damage, defacement, alteration, or destruction of property by the tenant is intentional, the tenant may be criminally charged with criminal mischief pursuant to chapter 716. 7. Act in a manner that will not disturb a neighbor’s peaceful enjoyment of the premises.
Iowa Code § 562A.17 establishes a set of baseline maintenance and conduct obligations that apply to tenants during their tenancy. The provision requires tenants to keep their unit clean and safe, properly dispose of waste, maintain plumbing fixtures, use building systems reasonably, avoid damaging the property, and refrain from disturbing neighbors. Intentional property damage may expose a tenant to criminal liability under Iowa's criminal mischief statute, chapter 716, in addition to any civil consequences.
Plain English — not legal advice.
Under Iowa Code § 562A.17, compliant property operators typically document the condition of a unit at move-in and move-out to establish a baseline for assessing whether tenant obligations were met. Operators generally maintain records of any reported damage, lease violations, or neighbor complaints, as these can be relevant if a dispute arises over security deposits or lease termination. When damage appears intentional, operators are aware that the provision expressly contemplates referral to criminal mischief statutes under chapter 716, separate from any civil remedies available to the landlord.

Iowa Code § 562A.17 outlines the maintenance and conduct standards tenants are expected to meet, including keeping the unit clean, disposing of waste properly, using appliances reasonably, and not damaging the property. Tenants who believe a landlord is attempting to hold them responsible for conditions that existed before their tenancy, or that fall outside these obligations, may raise that as a defense in a security deposit or eviction proceeding. Tenant-rights organizations in Iowa can help residents understand how § 562A.17 interacts with other provisions of chapter 562A, such as the landlord's own repair and maintenance duties.
