Iowa Admin. Code r. 161—9 § 161—9.25
Irregularities and objections.
Operative Text
9.25(1) Notice. All objections to any notice of taking any depositions are waived unless promptly served in writing upon the commission. 9.25(2) Officer. Objection to the commission investigator or other officer’s qualification to take a deposition is waived unless made before such taking begins, or as soon thereafter as objector knows it or could discover it with reasonable diligence. 9.25(3) Taking depositions. Errors or irregularities occurring during an oral deposition as to any conduct or manner of taking it, or the oath, or the form of any question or answer, and any other errors which might thereupon have been cured, obviated or removed, are waived unless seasonably objected to during the deposition.
Iowa Admin. Code r. 161—9 § 161—9.25 establishes a waiver framework for objections that arise during the deposition process in commission proceedings. Under this rule, parties who fail to raise objections promptly—whether about the notice of a deposition, the qualifications of the officer conducting it, or procedural errors occurring during the deposition itself—generally lose the right to raise those objections later. The rule reflects a broader principle that correctable problems must be flagged at the time they occur, not saved for a later stage of the proceeding.
Plain English — not legal advice.
Property owners or managers involved in Iowa Civil Rights Commission proceedings governed by Iowa Admin. Code r. 161—9 § 161—9.25 should be aware that procedural objections related to depositions must be raised at specific, timely moments. Compliant participants in such proceedings typically serve written objections to deposition notices promptly, challenge an officer's qualifications before the deposition begins, and voice objections to conduct or form during the deposition itself. Waiting until a later stage of the proceeding to raise issues that could have been addressed earlier is generally treated as a waiver of those objections.

Tenants or complainants participating in Iowa Civil Rights Commission proceedings subject to Iowa Admin. Code r. 161—9 § 161—9.25 have the right to object to procedural irregularities during depositions, but those rights must be exercised within the timeframes the rule specifies. For example, concerns about how a deposition is being conducted, the form of questions, or the qualifications of the officer taking the deposition should be raised at the time they arise. Tenant-rights organizations or legal aid services familiar with Iowa administrative procedure can help individuals understand how these procedural rules apply to their participation in a commission proceeding.
