Under Iowa Admin. Code r. 481—469 § 481—469.11, renovation, remodeling, or repainting work in target housing or child-occupied facilities is not subject to the lead-safe work practice requirements of Chapter 469 when two conditions are both met: a certified lead inspector or risk assessor (certified under Chapter 470) has issued a written determination that the affected components contain no lead-based paint, and the person performing the work has obtained a copy of that written determination. Without both elements in place, the exemption does not apply and the full Chapter 469 requirements remain in effect. This rule creates a documentation-based pathway out of the chapter's requirements rather than a blanket exclusion.

For Property Managers

Property owners and managers overseeing renovation, remodeling, or repainting in target housing or child-occupied facilities can rely on the exemption in Iowa Admin. Code r. 481—469 § 481—469.11 only when they have secured a written lead-free determination from a Chapter 470-certified inspector or risk assessor before work begins. Compliant operators typically retain a copy of that written determination on file and ensure it is accessible to the contractor or person performing the renovation. Operators generally confirm that the determination specifically covers the components being disturbed, since a partial or unrelated clearance document would not satisfy the exemption's requirements.

For Tenants

Iowa Admin. Code r. 481—469 § 481—469.11 provides that the lead-safe renovation requirements of Chapter 469 only fall away when a certified inspector has documented in writing that the specific components being worked on are free of lead-based paint and the renovator holds a copy of that document. Tenants in target housing or child-occupied facilities have an interest in knowing whether a claimed exemption is properly supported by that written determination. Those who have questions about whether an exemption was validly applied may contact the Iowa Department of Inspections and Appeals, consult a tenant-rights organization, or raise the absence of proper documentation as a concern in any relevant proceeding.
