K.A.R. 21-60-1 establishes the foundational definitions that govern Kansas fair housing and rental regulations under K.A.R. 21-60. The provision clarifies who qualifies as a broker or agent, what types of structures count as dwellings, and which individuals or entities meet the threshold to be considered 'in the business of selling or renting.' These definitions determine the scope of who and what is covered by the broader regulatory framework, including vacant land intended for residential construction.
Plain English — not legal advice.
Under K.A.R. 21-60-1, property owners who own buildings designed for five or more families, or who have participated in more than three sale or rental transactions in the past twelve months, are classified as persons 'in the business of selling or renting' and are subject to the full scope of K.A.R. 21-60 obligations. Compliant operators generally maintain awareness of how their transaction volume and portfolio size affect their regulatory classification. Those who use brokers or agents should also understand that those representatives' actions are covered under the same definitional framework.

K.A.R. 21-60-1 defines the key terms that establish which landlords, agents, and properties fall under Kansas's rental housing regulations, which is relevant context for tenants evaluating whether a particular housing situation is covered. Tenants dealing with a landlord or agent who meets the definitions in this provision may have access to protections under the broader K.A.R. 21-60 framework. Tenant-rights organizations or a state housing agency can help clarify whether a specific landlord or property meets these definitional thresholds.
