Kan. Admin. Regs. 21-60 § K.A.R. 21-60-12
Discrimination in the terms and conditions for making available loans or other financial assistance.
Operative Text
(a) It shall be unlawful for any person or entity engaged in making loans or providing other financial assistance relating to the purchase, construction, improvement, repair or maintenance of dwellings or in making loans which are secured by residential real estate, to impose different terms or conditions for the availability of such loans or other financial assistance because of race, religion, color, sex, disability, familial status, national origin or ancestry. (b) Unlawful practices under this act include, but are not limited to: (1) Using different policies, practices or procedures in evaluating or in determining the creditworthiness of any person in connection with the provision of any loan or other financial assistance for a dwelling, or for any loan or other financial assistance which is secured by residential real estate, because of race, religion, color, sex, disability, familial status, national origin or ancestry; and (2) Determining the type of loan or other financial assistance to be provided with respect to a dwelling, or fixing the amount, interest rate, duration or other terms for a loan or other financial assistance for a dwelling, or for any loan or other financial assistance which is secured by residential real estate, because of race, religion, color, sex, disability, familial status, national origin or ancestry.
K.A.R. 21-60-12 prohibits lenders and other financial institutions from applying different loan terms, conditions, or evaluation procedures based on a borrower's race, religion, color, sex, disability, familial status, national origin, or ancestry. This covers a wide range of lending activity tied to residential property, including purchase loans, construction financing, improvement loans, and loans secured by residential real estate. The rule makes clear that discriminatory treatment can occur at any stage of the lending process, from creditworthiness evaluation through the final setting of interest rates, loan amounts, and repayment terms.

Property owners who also act as private lenders or who work closely with financing partners should be aware that K.A.R. 21-60-12 applies to any entity involved in residential lending, not just traditional banks. Compliant lenders apply uniform underwriting standards, creditworthiness criteria, and loan terms regardless of an applicant's protected characteristics. Operators who refer tenants or buyers to financing sources generally take care to ensure those referral relationships do not result in differential treatment based on race, religion, color, sex, disability, familial status, national origin, or ancestry.

K.A.R. 21-60-12 gives prospective borrowers protection against discriminatory lending practices when seeking financing for a home purchase, construction, repair, or improvement. If a lender appears to have offered different interest rates, loan amounts, or evaluation criteria based on a protected characteristic such as race, disability, or national origin, that conduct may constitute a violation of this provision. Individuals who believe they have experienced such treatment can explore options such as filing a complaint with the Kansas Human Rights Commission, contacting a local fair housing organization, or consulting a tenant- or consumer-rights resource for guidance on available remedies.
