Kan. Admin. Regs. 28-72 § K.A.R. 28-72-1m
Definition.
Operative Text
In addition to the definitions in K.S.A. 65-1,201 and amendments thereto, the following term shall have the meaning assigned in this regulation: "Multifamily dwelling" means a structure that contains more than one separate residential dwelling unit used or occupied, or intended to be used or occupied, in whole or in part as the residence of one or more persons.
K.A.R. 28-72-1m establishes a working definition of 'multifamily dwelling' for the purposes of the regulations in K.A.R. 28-72. Under this definition, any structure containing more than one separate residential unit—whether currently occupied or intended for occupancy—qualifies as a multifamily dwelling. This definition builds on the broader set of terms already established in K.S.A. 65-1,201, ensuring consistent interpretation across the regulatory framework.
Plain English — not legal advice.
Property owners and managers should be aware that K.A.R. 28-72-1m defines 'multifamily dwelling' to include any structure with more than one separate residential unit, regardless of whether all units are currently occupied. Operators of duplexes, apartment buildings, and similar properties generally confirm whether their structures fall within this definition, since that classification determines which K.A.R. 28-72 requirements apply to them. Understanding this threshold is a foundational step in assessing compliance obligations under the broader regulatory scheme.
