Kan. Admin. Regs. 28-72 § K.A.R. 28-72-1o
Definitions.
Operative Text
In addition to the definitions in K.S.A. 65-1,201 and amendments thereto, each of the following terms shall have the meaning assigned in this regulation: (a) "Occupant protection plan" means a plan developed by a lead abatement supervisor or project designer before the commencement of lead abatement or lead hazard control in any structure designated by the act that describes the measures and management procedures to be taken during lead abatement or lead hazard control to protect the building occupants from exposure to any lead hazards. (b) "Occupation" means one of the specific disciplines of lead-based paint activities identified in this article for which individuals can receive training from training providers. This term shall include renovator, lead abatement worker, lead abatement supervisor, lead inspector, risk assessor, and project designer, and any combination of these. (c) "Oral exam" means a test that is equivalent in content to a corresponding written exam but is read to the student by the principal instructor. Each student taking an oral exam shall be required to provide the answers to the exam in writing.
K.A.R. 28-72-1o establishes working definitions for three terms used throughout Kansas's lead-based paint activity regulations. An 'occupant protection plan' is a pre-abatement document outlining how building residents will be shielded from lead exposure during hazard control work. 'Occupation' refers to the specific credentialed roles—such as renovator, inspector, or risk assessor—recognized under the lead-based paint training framework. An 'oral exam' is a spoken version of a standard written test, though examinees must still submit their answers in writing.

Property owners and managers overseeing lead abatement or lead hazard control work in Kansas should be familiar with the terminology defined in K.A.R. 28-72-1o, as these definitions govern how compliance obligations are interpreted throughout the regulation. A compliant operator generally ensures that any contractor performing lead-related work holds a recognized 'occupation' credential and that an 'occupant protection plan' is prepared by a qualified lead abatement supervisor or project designer before work begins. Understanding these definitions helps operators verify that hired professionals are meeting the procedural requirements the regulation sets out.

Tenants living in structures subject to Kansas lead abatement or lead hazard control work have an interest in knowing that K.A.R. 28-72-1o defines the 'occupant protection plan' as a document specifically designed to protect building residents from lead exposure during such work. This means a formal plan addressing resident safety is required before abatement activities commence, not after. Tenants who believe this protection is not being provided may consider contacting a local tenant-rights organization or the relevant Kansas regulatory authority to understand what documentation they are entitled to review.
