Kan. Stat. Ann. § 58-25,102
Jurisdiction of courts; procedure.
Operative Text
The district court shall have jurisdiction over a landlord or tenant with respect to conduct in this state governed by this act or with respect to any claim arising from a transaction subject to this act, and notwithstanding the provisions of subsection (b) of K.S.A. 61-2802, and amendments thereto, such actions may be commenced pursuant to the code of civil procedure for limited actions. Unless otherwise specifically provided in this act, the code of civil procedure for limited actions shall govern any action commenced pursuant to this act. If the relief sought is beyond the jurisdiction of a district magistrate judge as provided in K.S.A. 20-302b, and amendments thereto, the action shall be heard by a district judge.
Under Kan. Stat. Ann. §§ 58-2501 through 58-25,102, Kansas district courts hold authority over both landlords and tenants for any conduct or claim arising under the state's residential landlord-tenant act. Cases brought under this act may be filed using the streamlined code of civil procedure for limited actions, which governs the process unless the act specifies otherwise. When the relief a party seeks exceeds the jurisdictional limits of a district magistrate judge, the case must be heard by a district judge instead.
Plain English — not legal advice.
Kan. Stat. Ann. §§ 58-2501 through 58-25,102 establishes that Kansas district courts can exercise authority over property owners for any landlord-tenant matter governed by the act. Operators who need to pursue claims—such as unpaid rent or property damage—generally file in the limited-actions division when the amounts involved fall within that court's jurisdictional threshold. When a claim exceeds that threshold, compliant practice involves filing in the appropriate district court division presided over by a district judge.

Under Kan. Stat. Ann. §§ 58-2501 through 58-25,102, tenants have access to Kansas district courts to raise claims or defenses arising from their rental relationship, and the limited-actions procedure is designed to make that process more accessible. If a landlord files an action against a tenant, this provision means the case is subject to the same procedural framework, giving tenants a defined forum in which to respond. Tenants who believe their rights under the act have been violated may consider consulting a tenant-rights organization or legal aid office to understand which court and procedure applies to their situation.
