At the commencement of the term the landlord shall deliver possession of the mobile home space to the tenant in compliance with the rental agreement and K.S.A. 58-25,111. Plain English

Under Kan. Stat. Ann. §§ 58-2501 through 58-25,110, a landlord renting a mobile home space is required to deliver that space to the tenant at the start of the lease term in a condition that meets the rental agreement and the habitability standards set out in K.S.A. 58-25,111. If someone is occupying the space without legal right, the landlord has the authority to pursue a court action to regain possession and to seek monetary damages as outlined in K.S.A. 58-25,123. This provision establishes both the landlord's delivery obligation and the legal remedies available when possession is wrongfully withheld.

For Property Managers

Under Kan. Stat. Ann. §§ 58-2501 through 58-25,110, compliant mobile home park operators generally ensure that a rented space is fully ready and available to the incoming tenant on the first day of the lease term, consistent with the terms of the rental agreement and the standards referenced in K.S.A. 58-25,111. When a space is occupied by someone without a legal right to be there, operators typically pursue a formal court action for possession rather than self-help measures, and may also seek damages under K.S.A. 58-25,123. Keeping records of the lease commencement date and the condition of the space at move-in is a practice commonly associated with demonstrating compliance with this provision.

For Tenants

Kan. Stat. Ann. §§ 58-2501 through 58-25,110 gives tenants the right to receive their mobile home space at the start of the rental term in a condition that matches the rental agreement and meets the standards set in K.S.A. 58-25,111. If a landlord fails to deliver possession as required, tenants may have grounds to raise that failure as a legal issue, potentially including claims related to the damages framework in K.S.A. 58-25,123. Tenants who believe their right to possession was not honored may wish to consult a tenant-rights organization or legal aid office familiar with Kansas mobile home park law to understand the options generally available in such situations.
