Kan. Stat. Ann. § 58-25,124
Tenant's refusal to allow lawful access, remedies; landlord's unlawful or unreasonable entry, remedies.
Operative Text
(a) If the tenant refuses to allow lawful access to the mobile home space, the landlord may obtain injunctive relief to compel access or may terminate the rental agreement. In either case, the landlord may recover actual damages. (b) If the landlord makes an unlawful entry or a lawful entry to the mobile home space in an unreasonable manner or makes repeated demands for entry otherwise lawful but which have the effect of unreasonably harassing the tenant, the tenant may obtain injunctive relief to prevent the recurrence of the conduct or terminate the rental agreement. In either case, the tenant may recover actual damages.
Under Kan. Stat. Ann. § 58-25,124, Kansas mobile home space law establishes mutual access rights and remedies for both landlords and tenants. If a tenant refuses to allow lawful access to their mobile home space, the landlord may seek a court order compelling access or end the rental agreement, and may recover actual damages in either scenario. Conversely, if a landlord enters unlawfully, enters lawfully but in an unreasonable manner, or repeatedly demands entry in a way that amounts to harassment, the tenant may seek a court order to stop the conduct or terminate the rental agreement, and may also recover actual damages.
Plain English — not legal advice.
Kan. Stat. Ann. § 58-25,124 gives landlords a legal pathway when a tenant refuses to permit access that is otherwise lawful — operators in compliance with this provision typically document their access requests, ensure they are made at reasonable times and with proper notice, and pursue injunctive relief or agreement termination through the courts when access is wrongfully denied. Compliant operators are careful to avoid entries that could be characterized as unlawful, unreasonable, or harassing, since such conduct exposes them to the tenant's own remedies under the same statute. Keeping clear records of all access requests and the circumstances surrounding them is a practice generally associated with lawful property management under this provision.

Kan. Stat. Ann. § 58-25,124 provides tenants in mobile home spaces with explicit protections against unlawful entry, entry conducted in an unreasonable manner, and repeated demands for entry that function as harassment. Tenants who believe a landlord has violated this provision may pursue injunctive relief through the courts to prevent the conduct from recurring, or may choose to terminate the rental agreement, and may seek actual damages in either case. Tenants navigating these issues may find it helpful to document each instance of entry or demand and to consult a tenant-rights organization familiar with Kansas landlord-tenant law for general information about available options.
