Kan. Stat. Ann. § 58-2501
Tenants at will; terms of lease in certain cases.
Operative Text
Any person in the possession of real property with the assent of the owner is presumed to be a tenant at will, unless the contrary is shown except as herein otherwise provided. Where a landlord is renting farms in large numbers and a total acreage in excess of five thousand acres, and has tenants in excess of ten or more, and by the lease requires such tenants to erect or own and maintain substantially all of the buildings and improvements on the farm, such lease shall contain just and fair provisions for the free sale and transfer of such buildings and improvements, or the purchase thereof by the landlord, without requiring the tenant to remove the same from the land.
Under Kan. Stat. Ann. § 58-2501, any person occupying real property with the owner's knowledge and consent is legally presumed to be a tenant at will unless a different arrangement is demonstrated. The statute also addresses a specific large-scale agricultural leasing situation: when a landlord rents more than 5,000 acres across more than ten farm tenancies and the lease requires tenants to build or maintain most of the farm's structures, the lease must include fair terms allowing tenants to freely sell or transfer those buildings and improvements, or to have the landlord purchase them, without forcing the tenant to physically remove the structures from the land.
Plain English — not legal advice.
Operators managing large agricultural portfolios in Kansas should be aware that § 58-2501 imposes specific lease-drafting obligations when the operation exceeds 5,000 total acres and ten or more farm tenancies. In those circumstances, a compliant lease typically includes clear, equitable provisions addressing how tenant-owned buildings and improvements may be sold, transferred, or purchased by the landlord at the end of the tenancy. Beyond the large-farm context, landlords generally document the nature of any occupancy arrangement to avoid an unintended tenant-at-will presumption arising under this section.

Under Kan. Stat. Ann. § 58-2501, farm tenants who are required by their lease to build or maintain most of the structures on a large agricultural operation have a statutory right to fair terms governing what happens to those buildings and improvements when the tenancy ends — including the ability to sell or transfer them without being forced to remove them from the land. Tenants who believe their lease lacks these required provisions may wish to review the lease terms carefully and explore options such as raising the statutory requirement in any lease negotiation or renewal discussion. Tenant-rights organizations and legal aid services familiar with Kansas agricultural law can help explain how this provision may apply to a given lease arrangement.
