Kan. Stat. Ann. § 58-2528
Contents of affidavit; proceedings.
Operative Text
In an action to enforce a lien on crops for rent of farming lands, the affidavit for an attachment shall state that there is due from the defendant to the plaintiff a certain sum, naming it, for rent of farming lands, describing the same, and that the plaintiff claims a lien on the crop made on such land. Upon making and filing such affidavit and executing an undertaking as prescribed in the preceding section, an order of attachment shall issue as in other cases, and shall be levied on such crop, or so much thereof as may be necessary; and all other proceedings in such attachment shall be the same as in other actions.
Under Kansas law at Kan. Stat. Ann. §§ 58-2501–58-2528, when a landlord seeks to enforce a lien on crops grown on rented farming land, the process begins with a sworn affidavit that identifies the amount owed for rent, describes the farming land in question, and asserts a lien claim on the crops produced there. Once that affidavit is filed and a required undertaking (a form of security bond) is executed, a court may issue an attachment order directed at the crops. The attachment then proceeds under the same general rules that govern other attachment actions in Kansas courts.

Landlords of farming land in Kansas who are owed unpaid rent and wish to pursue a crop lien under Kan. Stat. Ann. §§ 58-2501–58-2528 generally prepare a sworn affidavit that precisely names the dollar amount claimed, describes the leased farming land, and asserts the lien on crops grown there. Compliant operators also execute the required undertaking before an attachment order can issue. Because the attachment proceedings follow standard Kansas attachment rules, landlords typically work within those existing court procedures to levy on the crops or the portion needed to satisfy the debt.

Tenants farming leased land in Kansas should be aware that under Kan. Stat. Ann. §§ 58-2501–58-2528, a landlord may initiate a legal process to attach crops as security for claimed unpaid rent by filing a sworn affidavit and posting a required undertaking. If an attachment order is issued against crops, tenants have the same rights to contest the attachment as exist in other Kansas attachment proceedings, including challenging the accuracy of the affidavit or the amount claimed. Tenants facing a crop attachment may wish to consult a tenant-rights organization or an attorney familiar with Kansas agricultural landlord-tenant law to understand available defenses and procedural options.
