Under Kan. Stat. Ann. §§ 58-5401–58-5405 (effective July 1, 2026), when an owner or the owner's agent seeks to remove an unauthorized occupant from a dwelling unit, a written notice must first be posted or delivered at the unit. That notice must inform the unauthorized person that they have no right to occupy the unit and must leave immediately, and it must identify the street address of the law enforcement agency where the supporting affidavit will be filed. Proof of delivery—including the date and time—must be attached to the affidavit as part of the process.

For Property Managers

Under §§ 58-5401–58-5405, compliant operators acting to remove an unauthorized occupant generally ensure that a written notice is prepared and delivered directly to the dwelling unit before proceeding further. The notice must state that the occupant has no right to be there and must vacate immediately, and it must include the street address of the relevant law enforcement agency. Operators also document the delivery by recording the date and time and attaching a copy of that notice to the affidavit submitted to law enforcement.

For Tenants

Kan. Stat. Ann. §§ 58-5401–58-5405 establish procedural steps an owner must follow before law enforcement involvement, including delivering a written notice to the dwelling unit that specifies the occupant has no right to remain and identifies the law enforcement agency where an affidavit will be filed. If a person receives such a notice, they may want to review whether the notice meets all statutory requirements, since procedural defects could be relevant to any subsequent proceedings. Tenant-rights organizations and legal aid offices familiar with Kansas housing law can help individuals understand what options may be available under this provision.
