Ky. Rev. Stat. ch. 344 § 344.210
Notice of complaint -- Hearing procedures
Operative Text
344.210 Notice of complaint -- Hearing procedures. (1) Within sixty (60) days after a complaint other than a complaint alleging a discriminatory housing practice is filed, unless the commission has issued an order dismissing the complaint or stating the terms of a conciliation agreement or within thirty (30) days after an application for review is filed under subsection (3) of KRS 344.200, the commission shall serve on the respondent by certified mail a written notice, together with a copy of the complaint as it may have been amended, requiring the respondent to answer the allegations of the complaint at a hearing held in accordance with this chapter and the provisions of KRS Chapter 13B. A copy of the notice shall be furnished to the complainant, the Attorney General, and any other public officers and persons that the commission deems proper. (2) A member of the commission who filed the complaint or endeavored to eliminate the alleged unlawful practice by conference, conciliation, or persuasion shall not participate in the hearing or in the subsequent deliberation of the commission. (3) The respondent shall file an answer with the commission by certified mail within twenty (20) days after receipt by the respondent of service under KRS 344.200. The commission or the complainant may amend a complaint and the respondent may amend an answer at any time prior to the issuance of final order pursuant to this section based on the complaint, but no final order shall be issued unless the respondent has had the opportunity of a hearing on the complaint or amendment on which the final order is based. (4) An administrative hearing on a discriminatory housing practice shall be held pursuant to this section and KRS 344.640 and administrative regulations promulgated pursuant to this chapter.
Kentucky Revised Statute § 344.210 establishes the procedural framework for handling civil rights complaints filed with the Kentucky Commission on Human Rights. Once a non-housing-discrimination complaint is filed, the commission generally has 60 days to formally notify the respondent by certified mail and require a hearing response; for housing discrimination complaints, a parallel track under § 344.640 applies. The respondent must file a written answer within 20 days of receiving service, and no final order may be issued without the respondent first having an opportunity to be heard. Commission members who were involved in filing or conciliating the complaint are barred from participating in the hearing or deliberations.

Property owners or managers named as respondents in a complaint proceeding under Ky. Rev. Stat. § 344.210 should be aware that they will receive formal notice by certified mail and are required to file a written answer with the Kentucky Commission on Human Rights within 20 days of receiving service. Compliant respondents typically respond within the statutory deadline and participate in the hearing process as outlined under KRS Chapter 13B. Operators generally maintain records of all certified mail correspondence and hearing-related documents, as amendments to complaints or answers may occur at any point before a final order is issued.

Under Ky. Rev. Stat. § 344.210, complainants have the right to receive a copy of the notice sent to the respondent, ensuring they are kept informed of the hearing process. The statute also protects the integrity of the proceeding by prohibiting any commission member who was involved in filing or conciliating the complaint from participating in the hearing or deliberations. Tenants who have filed a complaint may wish to consult a tenant-rights organization or legal aid provider to understand how the hearing procedures under § 344.210 and KRS Chapter 13B may apply to their situation.
