Kentucky Revised Statute § 344.250 establishes the investigative and record-keeping framework for the Kentucky Commission on Human Rights when it handles discrimination complaints. During an active investigation, the commission may request access to relevant premises, records, and documents, and may examine, photograph, or copy evidence. Information gathered through these powers is generally confidential and may not be publicly disclosed by commission staff without the affected person's consent, except as needed to conduct a formal proceeding. Entities that run apprenticeship or training programs face additional obligations to maintain applicant records in chronological order and to report that information upon request.

Under Ky. Rev. Stat. § 344.250, property owners and managers who are subject to Kentucky's civil rights chapter are generally expected to maintain records that could be relevant to determining whether unlawful housing practices have occurred, and to retain those records for periods prescribed by commission regulation. Compliant operators typically cooperate with commission requests for access to premises and documents during an investigation, and those who operate training or apprenticeship programs keep chronological applicant lists available for commission review. Operators who believe a particular record-keeping regulation would impose an undue hardship may apply to the commission for relief under subsection (4) of this provision.

Ky. Rev. Stat. § 344.250 supports the investigative process that follows a complaint filed under Kentucky's civil rights chapter, meaning that once a complaint is submitted, the commission has tools to gather evidence on a complainant's behalf. Tenants who have filed a complaint can generally expect that information the commission collects about them will be kept confidential and not disclosed publicly without their consent, as required by subsection (6). Those who believe a landlord or housing provider is not cooperating with a commission investigation may raise that concern with the Kentucky Commission on Human Rights or consult a tenant-rights organization familiar with the complaint process under this chapter.
