Ky. Rev. Stat. ch. 344 § 344.270
Commission or court not to take jurisdiction over claim for unlawful
Operative Text
344.270 Commission or court not to take jurisdiction over claim for unlawful practice while claim pending before the other body -- Final determination exclusive. The provisions of KRS 13B.140 notwithstanding, commission shall not take jurisdiction over any claim of an unlawful practice under this chapter while a claim of the same person seeking relief for the same grievance under KRS 344.450 is pending. A state court shall not take jurisdiction over any claim of an unlawful practice under this chapter while a claim of the same person seeking relief for the same grievance is pending before the commission. A final determination by a state court or a final order of the commission of a claim alleging an unlawful practice under KRS 344.450 shall exclude any other administrative action or proceeding brought in accordance with KRS Chapter 13B by the same person based on the same grievance.
Kentucky Revised Statutes § 344.270 establishes a 'one forum at a time' rule for unlawful-practice claims under Kentucky's civil rights chapter. If a person has filed the same grievance either before the Kentucky Commission on Human Rights or in state court, the other body is barred from accepting jurisdiction over that same claim while the first proceeding is still active. Once either the commission or a state court reaches a final decision on the claim, that outcome forecloses any further administrative proceeding by the same person based on the same grievance.
Plain English — not legal advice.
Under Ky. Rev. Stat. § 344.270, property owners and managers facing a fair-housing or unlawful-practice complaint should be aware that a complainant cannot simultaneously pursue the same grievance in both the Kentucky Commission on Human Rights and state court. Compliant operators typically track which forum a complaint has been filed in and respond accordingly, knowing that a final resolution in one forum ends the matter in the other. Understanding this procedural framework helps operators anticipate the scope and duration of a single proceeding rather than facing parallel actions.

Ky. Rev. Stat. § 344.270 means that if you file an unlawful-practice complaint, you generally must choose between pursuing it before the Kentucky Commission on Human Rights or in state court — you cannot have both proceedings running at the same time on the same grievance. A final outcome in whichever forum you use will close off the other avenue for that same claim. Tenants who are unsure which forum best fits their situation may want to consult a tenant-rights organization or legal aid office before filing, since this provision makes the choice consequential.
