Kentucky Revised Statute § 344.280 makes it an unlawful practice for any individual or group to conspire to retaliate against, obstruct, or interfere with people who exercise their civil rights protections under Kentucky's civil rights chapter. The provision covers a broad range of conspiratorial conduct, including aiding or abetting discriminatory acts, preventing compliance with the law, and interfering with the Kentucky Commission on Human Rights in carrying out its duties. It also specifically protects people who have filed complaints, testified, or otherwise participated in proceedings under the chapter from being targeted for that participation.

Property owners and managers operating under Kentucky's fair housing and civil rights laws should be aware that § 344.280 extends liability beyond direct discriminatory acts to include any coordinated effort to retaliate against, intimidate, or obstruct those who assert their rights. A compliant operator ensures that no staff member, agent, or contractor is directed or encouraged to take adverse action against a tenant or applicant because that person filed a complaint or participated in an investigation. Operators generally maintain clear anti-retaliation policies and document their responses to complaints in a manner that demonstrates good-faith compliance with the chapter.

Under Ky. Rev. Stat. § 344.280, tenants and housing applicants are protected not only from direct discrimination but also from any conspiracy to retaliate against them for opposing unlawful practices, filing complaints, or participating in proceedings under Kentucky's civil rights chapter. If a tenant believes they have experienced retaliation or interference with their rights, one general path is to file a complaint with the Kentucky Commission on Human Rights, which is empowered to investigate such conduct. Tenant-rights organizations can also help individuals understand the range of protections § 344.280 provides and the options available for addressing potential violations.
