Ky. Rev. Stat. ch. 344 § 344.605
Conciliation -- Agreement -- Final investigative report
Operative Text
344.605 Conciliation -- Agreement -- Final investigative report. (1) During the period beginning with the filing of a discriminatory housing practice complaint and ending with the filing of a charge or a dismissal by the commission, the commission shall, to the extent feasible, engage in conciliation with respect to a complaint. (2) A conciliation agreement arising out of the conciliation shall be an agreement between the respondent and the complainant, and shall be subject to approval by the commission. (3) A conciliation agreement may provide for binding arbitration of the dispute arising from the complaint. Any arbitration that results from a conciliation agreement may award appropriate relief, including monetary relief. (4) Each conciliation agreement shall be made public unless the complainant and respondent otherwise agree and the commission determines that disclosure is not required to further the purposes of this chapter. (5) (a) At the end of each investigation under this section, the commission shall prepare a final investigative report containing: 1. The names and dates of contacts with witnesses; 2. A summary and the dates of correspondence and other contacts with the complainant and the respondent; 3. A summary description of other pertinent records; 4. A summary of witness statements; and 5. Answers to interrogatories. (b) A final report under this paragraph may be amended if additional evidence is later discovered.
Kentucky Revised Statute § 344.605 establishes a conciliation process for housing discrimination complaints filed with the Kentucky Commission on Human Rights. From the time a complaint is filed until a formal charge is issued or the case is dismissed, the commission is required to attempt to bring the parties to a mutually acceptable resolution where feasible. Any agreement reached must be approved by the commission, may include binding arbitration with the possibility of monetary relief, and is generally made public unless both parties agree otherwise and the commission finds disclosure unnecessary. At the close of each investigation, the commission must compile a detailed final investigative report documenting contacts, correspondence, records, witness statements, and interrogatory answers.
Plain English — not legal advice.
Under Ky. Rev. Stat. § 344.605, a housing provider named as a respondent in a discrimination complaint can expect the Kentucky Commission on Human Rights to reach out about conciliation before any formal charge is filed. Operators who engage in good faith with the conciliation process may negotiate a written agreement that, once commission-approved, can resolve the matter and potentially include binding arbitration in lieu of further proceedings. Maintaining organized records of tenant communications, property policies, and any relevant correspondence is a practice that supports a respondent's ability to participate effectively in the investigative and conciliation stages outlined in this statute.

Ky. Rev. Stat. § 344.605 gives complainants the right to participate in a commission-facilitated conciliation process after filing a housing discrimination complaint, with the goal of reaching a negotiated resolution before a formal charge is issued. Any agreement reached is subject to commission approval and may include monetary relief through arbitration, providing a potential remedy without a full adjudication. Tenants who have filed a complaint may wish to review the final investigative report prepared under this section, and tenant-rights organizations or legal aid services can help explain what rights and options are available during the conciliation and investigation process.
