Ky. Rev. Stat. ch. 344 § 344.630
Service of charge
Operative Text
344.630 Service of charge. After the commission issues a discriminatory housing charge under KRS 344.625, the commission shall cause a copy thereof, together with information as to how to make an election of an administrative or judicial choice of forum under KRS 344.635, and the effect of such election, to be served: (1) On each respondent named in the charge, together with a written notice of opportunity for a hearing at a time and place specified in the notice, unless that election is made; and (2) On each aggrieved person on whose behalf the discriminatory housing complaint was filed.
Kentucky Revised Statute § 344.630 establishes the process by which the Kentucky Commission on Human Rights delivers a discriminatory housing charge after it has been issued under KRS 344.625. Once the charge is issued, the Commission must serve a copy of it on every named respondent along with notice of a hearing opportunity, and separately on every aggrieved person on whose behalf the complaint was originally filed. The service also includes information explaining how to choose between an administrative or judicial forum under KRS 344.635 and what the consequences of that choice are.

Under Ky. Rev. Stat. § 344.630, a property owner or manager named as a respondent in a discriminatory housing charge can expect to receive formal service of that charge from the Kentucky Commission on Human Rights. That service will include a written notice specifying the time and place of a potential hearing, as well as information about the option to elect either an administrative or a judicial forum under KRS 344.635. Operators who receive such service generally review the election-of-forum information carefully, as that choice carries distinct procedural consequences described in the accompanying notice.

Ky. Rev. Stat. § 344.630 provides that an aggrieved person on whose behalf a discriminatory housing complaint was filed is entitled to receive a copy of any discriminatory housing charge the Commission issues. This ensures that the person who brought the complaint is kept informed of the formal charge and the forum-election process available under KRS 344.635. Tenants or other aggrieved individuals who believe they have not received proper service under this provision may wish to contact the Kentucky Commission on Human Rights directly or consult a tenant-rights organization to understand their options.
