Ky. Rev. Stat. ch. 344 § 344.640
Administrative proceedings
Operative Text
344.640 Administrative proceedings. (1) If a timely election of a judicial or administrative remedy is not made under KRS 344.635, with respect to a discriminatory housing charge, the commission shall provide an opportunity for an administrative hearing in accordance with the provisions of this chapter and KRS Chapter 13B with respect to the charge issued under KRS 344.625. (2) Any resolution of a discriminatory housing charge before a final order under this section shall require the consent of the aggrieved person on whose behalf the discriminatory housing charge is issued. (3) The provisions of KRS 13B.140 notwithstanding, the commission may not continue administrative proceedings under this section regarding any alleged discriminatory housing practice after the beginning of the trial of a civil action commenced by the aggrieved party under a state or federal law, seeking relief with respect to that discriminatory housing practice.
Kentucky Revised Statutes § 344.640 establishes the process for administrative hearings on discriminatory housing charges in Kentucky. When a complainant does not elect a judicial or administrative remedy within the required timeframe under KRS 344.635, the Kentucky Commission on Human Rights must offer an administrative hearing on the charge. Any settlement reached before a final administrative order requires the consent of the person who brought the complaint, and the administrative process must stop if the aggrieved party begins a civil trial in state or federal court over the same alleged discriminatory housing practice.

Under KRS § 344.640, property owners and managers facing a discriminatory housing charge should be aware that the administrative hearing process is governed by both this chapter and KRS Chapter 13B. A compliant operator generally keeps thorough records of all housing decisions and communications, since those records may be relevant in either an administrative or judicial proceeding. Operators should also understand that if the complainant initiates a civil trial in state or federal court, the administrative proceedings under this section must cease, meaning the forum for resolving the matter can shift during the process.

KRS § 344.640 provides important procedural protections for individuals who have filed a discriminatory housing charge in Kentucky. Under this provision, any resolution of your charge before a final administrative order requires your consent, meaning a settlement cannot be imposed on you without your agreement. If you are navigating this process, tenant-rights organizations and legal aid services can help you understand the choice between administrative and judicial remedies, and how filing a civil lawsuit may affect ongoing administrative proceedings under this section.
