Ky. Rev. Stat. ch. 80 § 80.520
"Farmers of low income" defined
Operative Text
80.520 "Farmers of low income" defined. "Farmers of low income," as used in KRS 80.510 and 80.530, shall mean persons or families who at the time of their admission to occupancy in a dwelling of a housing authority: (1) Live under unsafe or unsanitary housing conditions; (2) Derive their principal income from operating or working upon a farm; and (3) Had an aggregate average annual net income for the three (3) years preceding their admission that was less than the amount determined by the housing authority to be necessary, within its area of operation, to enable them, without financial assistance, to obtain decent, safe and sanitary housing, without overcrowding. History: Created 1942 Ky. Acts ch. 70, sec. 22.
Kentucky Revised Statute § 80.520 establishes a specific definition for the phrase 'farmers of low income' as it is used in the surrounding statutes governing housing authorities. To qualify under this definition, a person or family must meet three conditions at the time they are admitted to a housing authority dwelling: they must currently live in unsafe or unsanitary housing, they must earn their primary income from farming or farm labor, and their average annual net income over the preceding three years must fall below the threshold the local housing authority has set for obtaining decent housing without assistance. This definition shapes eligibility determinations for housing authority programs aimed at agricultural workers in Kentucky.
Plain English — not legal advice.
Housing authorities and operators working within programs governed by KRS 80.520 generally maintain clear documentation of each applicant's housing conditions, primary income source, and three-year income history at the time of admission. Because the income threshold under § 80.520 is set by the individual housing authority within its area of operation, compliant administrators typically establish and publish that threshold in advance so eligibility determinations are consistent and transparent. Operators administering these programs keep records sufficient to demonstrate that admitted occupants met all three statutory criteria at the time of their admission.

KRS 80.520 defines who qualifies as a 'farmer of low income' for purposes of housing authority programs in Kentucky, and meeting this definition may be a prerequisite for admission to certain housing authority dwellings. Tenants who believe they meet all three criteria — unsafe or unsanitary current housing, farm-based primary income, and a three-year average income below the authority's threshold — can inquire directly with the local housing authority about how that income threshold has been set and how eligibility is evaluated. Tenant-rights organizations familiar with Kentucky housing authority programs can help individuals understand how § 80.520 applies to their circumstances and what documentation is typically relevant to an eligibility review.
