Ky. Rev. Stat. ch. 80 § 80.530
Rentals and tenant selection -- Restrictions
Operative Text
80.530 Rentals and tenant selection -- Restrictions. Except with regard to housing for farmers of low income, a housing authority shall be subject to the same limitations and restrictions on rentals and tenant selection which are applicable to housing authorities created for cities under KRS 80.010 to 80.250. History: Created 1942 Ky. Acts ch. 70, sec. 23.
Kentucky Revised Statutes § 80.530 establishes that county housing authorities face the same rules governing how they set rents and select tenants as city-based housing authorities operating under KRS 80.010 to 80.250, with one exception: housing designated for low-income farmers is carved out from these requirements. This provision ensures a consistent regulatory framework across different types of public housing authorities in Kentucky. The rule effectively prevents county housing authorities from adopting rental or tenant-selection practices that would otherwise be prohibited for their city counterparts.

Operators and administrators of county housing authorities in Kentucky should be aware that KRS § 80.530 ties their rental pricing and tenant-selection practices to the same standards that govern city housing authorities under KRS 80.010 to 80.250. Compliant operators generally apply the same eligibility criteria, income limits, and rental rate structures required of city-based authorities. The only recognized exception under this provision covers housing specifically designated for low-income farmers, which may be administered under different standards.

Under KRS § 80.530, residents of county public housing in Kentucky are generally entitled to the same tenant-selection protections that apply to city housing authority tenants under KRS 80.010 to 80.250. If a county housing authority appears to be applying rental terms or selection criteria that deviate from those standards, tenants may have grounds to raise that inconsistency through a formal complaint or administrative process. Tenant-rights organizations familiar with Kentucky public housing law can help individuals understand what protections apply to their housing situation under this provision.
