La. Stat. Ann. § R.S. 40:510
Exclusion or ejection of unauthorized persons
Operative Text
§510. Exclusion or ejection of unauthorized persons Persons who are present on the developments or other property of the authority, and who are not residents, their guests, or employees of the local housing authority, its guests, law enforcement officers, or others conducting official business, may be excluded from such premises by the local housing authority, and, if said persons shall refuse to leave, after first being requested to do so, said persons shall be considered trespassers who shall be subject to an applicable state or local trespass law. Additionally, and without limiting the foregoing, the local housing authority may obtain injunctions for the temporary or permanent exclusion of such persons from authority property.
Under La. R.S. § 40:510, local housing authorities in Louisiana have the legal power to remove people from public housing developments who are not residents, authorized guests, employees, law enforcement, or others on official business. Anyone who refuses to leave after being asked may be treated as a trespasser under applicable state or local law. The provision also allows housing authorities to seek court injunctions to temporarily or permanently bar such individuals from authority property.
Plain English — not legal advice.
Local housing authorities operating under La. R.S. § 40:510 generally maintain clear policies identifying who qualifies as an authorized resident, guest, or official visitor on their properties. Compliant operators typically document requests for unauthorized persons to leave before pursuing trespass enforcement or seeking injunctive relief. Maintaining consistent records of exclusion requests and any follow-up actions supports the authority's ability to enforce this provision through available legal channels.

As a resident of a public housing development, La. R.S. § 40:510 recognizes your right to have guests on the property, provided they are authorized under the housing authority's policies. If you believe the authority has improperly excluded someone you consider a legitimate guest, tenant-rights organizations or legal aid services in Louisiana can help you understand how this provision applies. Residents who feel their rights under this section have been affected may also raise concerns directly with their local housing authority or through applicable grievance procedures.
