La. Stat. Ann. § R.S. 40:580.7
Powers of public officers
Operative Text
§580.7. Powers of public officers An ordinance adopted by the council of the municipality may authorize the public officer to exercise any powers necessary or convenient to carry out and effectuate the purposes and provisions of this Part, including the following: (1) To investigate the dwelling conditions in the municipality to determine which dwellings therein are unfit for human habitation. (2) To administer oaths and affirmations and examine witnesses and receive evidence. (3) To enter upon premises for the purpose of making examinations provided the entries are made in such manner as to cause the least possible inconvenience to the persons in possession. (4) To appoint and fix the duties of such officers, agents, and employees as he thinks necessary to carry out the purposes of the ordinance.
La. R.S. § 40:580.7 establishes the range of powers that a municipal public officer may be granted through local ordinance to enforce housing fitness standards. These powers include investigating dwelling conditions, administering oaths, entering properties to conduct inspections, and appointing staff. The provision does not automatically confer these powers — a municipality must first adopt an ordinance authorizing them.

Under La. R.S. § 40:580.7, a public officer acting under a duly adopted municipal ordinance may enter rental properties to inspect for conditions that render a dwelling unfit for human habitation. Operators who maintain properties in compliance with local housing codes generally experience fewer formal investigations and enforcement actions. Keeping records of maintenance, repairs, and inspections can support a showing of compliance if a public officer initiates an inquiry.

La. R.S. § 40:580.7 gives municipally authorized public officers the ability to investigate dwelling conditions and enter premises to assess whether a unit is unfit for human habitation. Tenants who believe their unit has serious habitability problems may be able to request that the local public officer conduct an inspection under this authority. Tenant-rights organizations and local housing agencies can help residents understand how to engage with the inspection and enforcement process established by their municipality's ordinance.
