La. Stat. Ann. § R.S. 46:2255
Construction
Operative Text
§2255. Construction Nothing in this Act shall be construed to prohibit or alter any program, service, facility, school, or privilege which is afforded, oriented, or restricted to a person because of his disability, from continuing to habilitate, rehabilitate, or accommodate that person.
La. R.S. § 46:2255 is a construction clause within Louisiana's disability-rights law that preserves the legality of programs, services, facilities, schools, or privileges that are specifically designed for, oriented toward, or limited to people with disabilities. The provision clarifies that the broader Act is not meant to dismantle or alter specialized habilitation, rehabilitation, or accommodation efforts aimed at disabled individuals. In other words, disability-specific programs that benefit their participants remain permissible and unaffected by the Act's other requirements.
Plain English — not legal advice.
Property owners and managers who operate or participate in housing programs specifically designed to serve people with disabilities should be aware that La. R.S. § 46:2255 preserves the validity of such targeted offerings. A compliant operator generally ensures that any disability-oriented program or accommodation service it provides continues to function as intended without treating this Act as a reason to discontinue those efforts. Maintaining documentation of the purpose and structure of disability-specific programs can help demonstrate that they fall within the scope of what this provision protects.

Tenants with disabilities who participate in specialized housing programs, rehabilitation services, or accommodation arrangements should know that La. R.S. § 46:2255 explicitly protects those programs from being dismantled under this Act. If a landlord or housing provider attempts to eliminate a disability-specific service by citing this Act as justification, that interpretation would be inconsistent with what § 46:2255 actually says. Tenants in that situation may consider reaching out to a local tenant-rights organization or a disability-rights advocacy group to understand what options may be available.
