La. Stat. Ann. § R.S. 51:2240
Enforcement of local commission orders
Operative Text
§2240. Enforcement of local commission orders A. The proceeding for enforcement of a local commission order shall be initiated by filing a complaint in the district court. Copies of the complaint shall be served upon all parties of record. Within thirty days after the filing of the complaint by the local commission, or within such further time as the court may allow, the local commission shall transmit to the court the original or a certified copy of the entire record upon which the order is based, including a transcript of testimony, which need not be printed. By stipulation of all parties to the proceeding, the record may be shortened. B. The findings of fact of the local commission shall be conclusive unless clearly erroneous in view of the probative and substantial evidence on the whole record. The court may grant such temporary relief or restraining order as it deems just and may enter an order enforcing, modifying, and enforcing as modified, or setting aside in whole or in part the order of the local commission, or remanding the case to the local commission for further proceedings.
La. R.S. § 51:2240 establishes the process by which orders issued by a local commission can be enforced through the courts. Under this provision, enforcement begins when a complaint is filed in district court, and the local commission must submit the full record of its proceedings to the court within thirty days. The court reviews the commission's factual findings with deference—treating them as conclusive unless clearly erroneous—and may uphold, modify, set aside, or remand the commission's order.

Property owners or managers subject to a local commission order should be aware that under La. R.S. § 51:2240, that order can be brought before a district court for enforcement. A compliant operator generally keeps thorough records of all commission proceedings, since the entire record—including testimony transcripts—is transmitted to the court. Understanding that the commission's factual findings carry significant weight in court helps operators appreciate the importance of fully participating in commission hearings.

Tenants who have obtained a favorable ruling from a local commission may find La. R.S. § 51:2240 relevant if that order needs to be enforced through the courts. This provision outlines a formal judicial process, including the submission of the commission's full record, that can be used to give legal effect to a commission's decision. Tenants navigating this process may benefit from consulting a tenant-rights organization or legal aid provider familiar with Louisiana housing law.
