La. Stat. Ann. § R.S. 51:2608
Discrimination in provision of brokerage services
Operative Text
§2608. Discrimination in provision of brokerage services It is unlawful to deny any person access to or membership or participation in any multiple-listing service, real estate brokers' organization or other service, organization, or facility relating to the business of selling or renting dwellings, or to discriminate against him in the terms or conditions of such access, membership, or participation, on account of race, color, religion, sex, disability, familial status, national origin, military status, or natural, protective, or cultural hairstyle.
Under La. R.S. § 51:2608, real estate industry organizations—including multiple-listing services and brokers' associations—may not bar anyone from joining, participating in, or accessing their services because of characteristics such as race, religion, sex, disability, familial status, national origin, military status, or hairstyle. The rule also covers discriminatory differences in the terms or conditions of that access, not just outright denial. In short, the provision extends fair-housing protections into the professional infrastructure that supports buying and renting homes.

Property owners and managers who participate in multiple-listing services or real estate brokers' organizations should be aware that La. R.S. § 51:2608 governs how those organizations treat their members and participants. Compliant operators generally ensure that any organization they work with does not apply different membership terms based on protected characteristics, including natural, protective, or cultural hairstyle. Reviewing the membership and participation policies of affiliated real estate organizations is a standard practice for operators seeking to align with this provision.

La. R.S. § 51:2608 establishes that individuals cannot be excluded from or treated unequally within real estate services organizations—such as MLS platforms—on the basis of protected characteristics including race, disability, familial status, or hairstyle. Tenants and prospective buyers who believe they have been denied access to such services on a prohibited basis may have grounds to raise that as a violation. General enforcement paths include filing a complaint with a fair-housing agency, contacting a tenant-rights or fair-housing organization, or consulting an attorney familiar with Louisiana fair-housing law.
