Operative Text
As used in this chapter, unless the context otherwise indicates, the following terms have the following meanings. 1. Mobile home. "Mobile home" means a structure, transportable in one or more sections, which: A. Is 8 body feet or more in width and 32 body feet or more in length; B. Is built on a permanent chassis; C. Is designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities; and D. Includes the plumbing, heating, air-conditioning and electrical systems contained in the structure. 2. Mobile home park. "Mobile home park" means any parcel of land under single or common ownership or control which contains, or is designed, laid out or adapted to accommodate 2 or more mobile homes. 2-A. Controlling interest. "Controlling interest" means: A. In the case of a corporation, more than 50% of the total combined voting power of all classes of stock of the corporation entitled to vote or more than 50% of the capital, profits or beneficial interest in the voting stock of the corporation; and B. In the case of a partnership, association, trust or other entity, more than 50% of the capital, profits or beneficial interest in the partnership, association, trust or other entity. For the purposes of this subchapter, to determine whether a purchase or acquisition of a controlling interest has taken place, all actions of persons acting in concert are aggregated. Persons must be treated as acting in concert when they have a relationship with each other such that one person influences or controls the actions of another through common ownership. 3. Normal wear and tear. "Normal wear and tear" means that deterioration which occurs, without negligence, carelessness, accident or abuse of the premises or equipment by the tenant, members of the tenant's household or their invitees or guests. The term does not include sums or labor expended by the landlord in removing articles abandoned by the tenant, such as trash, from the premises. 3-A. Purchase of mobile home park. "Purchase of a mobile home park" means the purchase or acquisition of a mobile home park or of the direct or indirect controlling interest in the owner of a mobile home park. 3-B. Purchaser of mobile home park. "Purchaser of a mobile home park" means a person that purchases or acquires a mobile home park or a direct or indirect controlling interest in the owner of a mobile home park. 3-C. Sale of mobile home park. "Sale of a mobile home park" means any sale or transfer of a mobile home park or of the direct or indirect controlling interest in the owner of a mobile home park. 4. Security deposit. "Security deposit" means any advance or deposit of money, the primary function of which is to secure the performance of a rental agreement for a mobile home, including premises used solely for the storage or display of mobile homes. 5. Tenant. "Tenant" means a mobile home owner who rents a parcel of land in a mobile home park.
Section 9091 of Maine's mobile home statutes establishes the foundational vocabulary used throughout the chapter governing mobile home parks. It defines key terms such as "mobile home," "mobile home park," "controlling interest," "normal wear and tear," "security deposit," and "tenant," setting the precise scope of who and what is covered by the chapter's protections and obligations. Notably, a "tenant" under § 9091 is specifically a mobile home *owner* who rents land within a park — not someone renting the home itself — and a "security deposit" covers money advanced to secure a rental agreement for a mobile home lot.
Plain English — not legal advice.
Under § 9091, operators of mobile home parks should be aware that the chapter's definitions tightly bound which relationships and properties fall under its rules. A "mobile home park" requires only two or more qualifying mobile homes on commonly owned or controlled land, so even small parcels may trigger the chapter's requirements. The definition of "controlling interest" — set at more than 50% of voting power or beneficial interest — is particularly relevant when ownership of a park changes hands through a corporate or partnership structure, as aggregated actions of persons acting in concert are counted together.

If you are a mobile home owner renting a lot in a Maine mobile home park, § 9091 establishes that you qualify as a "tenant" under this chapter and are entitled to its protections. The definition of "normal wear and tear" in § 9091 is meaningful when it comes to security deposit disputes, as it excludes deterioration caused by negligence or abuse but does not require you to cover ordinary aging of the premises. Tenants who believe their rights under this chapter have been violated may wish to consult a tenant-rights organization or review the Maine Attorney General's guidance on mobile home park law.
