Me. Rev. Stat. tit. 10, ch. 953 § 9093-A
Fees charged to applicants for lease of mobile home or mobile home park lot
Operative Text
1. Fees prohibited generally. Except as provided in subsection 2 , a mobile home park owner or operator may not require an applicant to pay a fee to submit an application to enter into an agreement for rental of a mobile home or mobile home park lot or require an applicant to pay a fee for the mobile home park owner or operator to review or approve an application to enter into an agreement for rental of a mobile home or mobile home park lot. 2. Exceptions. A mobile home park owner or operator, in connection with an application to enter into an agreement for rental of a mobile home or mobile home park lot, may require an applicant to pay only one of the following: A. The actual cost of a background check; B. The actual cost of a credit check; or C. The actual cost of a screening process other than those specified in paragraphs A and B . A mobile home park owner or operator shall provide an applicant with a complete copy of the information obtained pursuant to a background check, credit check or other screening process. A mobile home park owner or operator may not charge an applicant any fee under this subsection unless the mobile home park owner or operator has notified the applicant that the mobile home park owner or operator is required by law to provide the applicant a complete copy of the information obtained pursuant to the background check, credit check or other screening process. A mobile home park owner or operator may not charge an applicant more than one fee for a background check, credit check or other screening process in any 12-month period.
Under 10 M.R.S. §§ 9091 & 9093-A, mobile home park owners and operators in Maine are generally barred from charging applicants fees simply to submit or have reviewed a rental application for a mobile home or lot. The only permissible charges are the actual costs of a background check, credit check, or other screening process — and only one such fee may be collected within any 12-month period. Whenever a screening fee is charged, the operator must first notify the applicant that they are entitled by law to receive a complete copy of all information obtained, and must then actually provide that copy.

Operators subject to 10 M.R.S. §§ 9091 & 9093-A generally limit their application-related charges to the documented actual cost of a single screening tool — background check, credit check, or equivalent — per applicant within any rolling 12-month window. Before collecting any such fee, compliant operators notify applicants in writing that Maine law entitles them to a full copy of the screening results, and they follow through by delivering that complete copy. Maintaining clear records of fee amounts, the notice provided, and the information disclosed helps demonstrate adherence to these requirements.

Under 10 M.R.S. §§ 9091 & 9093-A, Maine applicants for mobile home or lot rentals have the right to be free from general application fees, and any screening fee charged must reflect only the actual cost of the check performed. Applicants are also entitled to receive advance notice of their right to a complete copy of screening results, and to receive that copy once the process is complete. Tenants or applicants who believe these protections have been violated may consider contacting a Maine tenant-rights organization, reaching out to the Maine Attorney General's consumer protection office, or raising the violation as a defense or claim in a relevant legal proceeding.
