Plain English

Under 10 M.R.S. §§ 9091–9097-C, Maine law sets specific rules for when and how mobile home park owners may charge late fees on rent. A rent payment is considered late only after 15 days have passed from its due date, and any penalty assessed cannot exceed 4% of one month's rent. Additionally, the right to charge such a penalty only exists if the tenant was given written notice of the potential fee at the time the rental agreement was signed.

For Property Managers

Under 10 M.R.S. §§ 9091–9097-C, compliant mobile home park operators ensure that any late-fee provision is disclosed in writing to the tenant at the time the rental agreement is executed, not after the fact. Operators also confirm that no late fee is assessed until at least 15 days after the rent due date, and that the fee charged does not exceed 4% of one month's rent. Maintaining clear records of the written notice provided at lease signing is a standard practice for operators seeking to remain in compliance with this provision.

For Tenants

Under 10 M.R.S. §§ 9091–9097-C, tenants in Maine mobile home parks have the right to a 15-day grace period before any late fee can be charged, and that fee cannot exceed 4% of one month's rent. Importantly, a late fee is only permissible if the tenant received written notice of the potential penalty at the time the rental agreement was entered into — without that notice, the fee may not be enforceable. Tenants who believe a late fee was improperly charged may consider raising this provision as a defense in any related proceeding, consulting a tenant-rights organization, or contacting a local legal aid office for general information about their options.
