Under 30-A M.R.S. § 4973-A, owners of low-income rental housing in Maine are required to give advance written notice when an affordability restriction or financial assistance program tied to their property is set to expire. The notice must go to current tenants, any organized tenant group at the property, the Maine State Housing Authority, and any applicable municipal housing authority. The rule specifies what the notice must contain, when it must be sent (generally at least two years before termination, or by November 30, 2025 if termination is sooner), and how it must be delivered—including first-class mail with return receipt and physical delivery to each tenant's door.

For Property Managers

Owners and controlling-interest holders of low-income rental housing in Maine must comply with the notification framework established by 30-A M.R.S. § 4973-A well before any affordability restriction or financial assistance is scheduled to end. A compliant operator prepares a notice that includes the property address, the owner's name and address, the termination date, and any additional information the Maine State Housing Authority requires by rule. That notice is then sent by first-class mail with return receipt requested to all required recipients—tenants, any tenants' organization, the Maine State Housing Authority, and the relevant municipal housing authority—and is also physically delivered to each tenant's dwelling unit by leaving it in or under the door.

For Tenants

Section 4973-A of Title 30-A of Maine Revised Statutes gives tenants in low-income rental housing the right to receive advance written notice before the affordability restrictions or financial assistance on their building expires. This notice must be delivered both by first-class mail with return receipt and by physical placement at the tenant's door, and it must disclose the termination date and owner information. Tenants who believe they did not receive required notice under § 4973-A may consider reaching out to the Maine State Housing Authority or a local tenant-rights organization to understand what options may be available to them.
