(c) “Homeowner” means an owner of a manufactured home who leases or rents a lot in a manufactured housing community for residential use. (d) “Homeowners organization” means an incorporated or unincorporated organization, including a cooperative housing corporation, that: (1) Represents the interests of the homeowners in a manufactured housing community; (2) Is open to all homeowners residing in the manufactured housing community; (3) Is controlled by the members of the organization; and (4) Comprises homeowners who lease or rent at least 75% of the lots in the manufactured housing community. Section 8A-1801 of Maryland's Real Property Code establishes the foundational definitions for the subtitle governing manufactured housing communities. It clarifies who qualifies as a 'community owner,' 'homeowner,' and 'homeowners organization,' and specifies what constitutes a 'manufactured housing community.' Notably, a homeowners organization must be open to all residents, member-controlled, and represent homeowners who lease at least 75% of the lots in the community. These definitions set the scope for the rights and obligations that follow throughout the rest of the subtitle.
Plain English — not legal advice.
As a manufactured housing community owner under § 8A-1801, operators should be aware that the definitions in this section determine which rules apply to their property and their relationships with residents. A community that leases lots to two or more manufactured home owners for residential use falls within the subtitle's scope, including any property referred to as a 'park.' Compliant community owners generally maintain clear records of lot leases and recognize formally organized homeowners organizations that meet the statutory criteria, since those organizations carry specific rights under the broader subtitle.

Under § 8A-1801, Maryland law recognizes manufactured home residents who lease or rent lots as 'homeowners' with standing under this subtitle's protections. Tenants in these communities may also have the ability to form or join a qualifying homeowners organization—one that is open to all residents, member-controlled, and represents lessees of at least 75% of the lots—which can serve as a vehicle for collective engagement with the community owner. Residents who want to understand how these definitions affect their specific rights may consider reaching out to a tenant-rights organization or consulting the Maryland Attorney General's Consumer Protection Division for general guidance.
