Plain English — not legal advice.
Property owners and managers subject to 105 Mass. Code Regs. § 410.250 generally conduct routine inspections of all asbestos-containing materials in their buildings to identify any signs of deterioration, such as cracks, tears, or looseness. When a defect is found, compliant operators arrange for remediation that meets the accepted standards referenced in 105 CMR 410.010, which typically involves licensed asbestos professionals. Maintaining documentation of inspections and any corrective work is a common practice among operators seeking to demonstrate ongoing compliance with this provision.

Under 105 Mass. Code Regs. § 410.250, tenants have a right to live in a dwelling where asbestos-containing materials are maintained in good repair and pose no risk of releasing asbestos dust or friable material. If a tenant observes deteriorating asbestos-containing material, they may report the condition to their local board of health, which has authority to inspect and cite violations of this provision. Tenants can also reach out to a local tenant-rights organization to better understand the range of options available, including how a documented violation under § 410.250 might be relevant in other housing proceedings.
