Cal. Civ. Code § 410.810
Hearing Notice
Operative Text
(A) Upon receipt of a petition, the board of health shall inform the petitioner and other affected
persons in writing of the date, time and place of the hearing and of their right to inspect and copy
the board of health's file concerning the matter to be heard.
(B) If a written petition for a hearing is not filed with the board of health within the appropriate
time provided for in 105 CMR 410.800, the right to a hearing is waived.Section 410.810 of the Massachusetts Sanitary Code governs how hearing notices are issued and how the right to a hearing can be lost. When a board of health receives a petition, it must notify the petitioner and any other affected parties in writing, specifying the hearing's date, time, and location, and informing them of their right to review the board's file on the matter. If a written petition is not submitted within the timeframe set out in 105 CMR 410.800, the opportunity to request a hearing is forfeited entirely.
Plain English — not legal advice.
Under 105 Mass. Code Regs. § 410.810, property owners who receive notice of a board of health action and wish to contest it generally ensure that any written petition for a hearing is filed within the deadline established by 105 CMR 410.800. Compliant operators also take note of the written hearing notice they receive from the board, which will specify the date, time, and place of the proceeding. Operators typically review the board of health's file on the matter, a right explicitly preserved by this provision, to prepare for the hearing.

Section 410.810 protects tenants and other affected persons by requiring the board of health to provide written notice of any scheduled hearing, including the date, time, and location, as well as the right to inspect and copy the board's file on the matter. Tenants who wish to participate in a hearing should be aware that under 105 CMR 410.800, a written petition must be filed within a specific timeframe, and § 410.810(B) makes clear that missing that deadline results in a waiver of the hearing right. Tenant-rights organizations and legal aid offices can help individuals understand applicable deadlines and what the board's file may contain.
