Plain English

Under 105 Mass. Code Regs. 410.000 § 410.920, any person who fails to comply with an order issued under the Massachusetts Minimum Standards of Fitness for Human Habitation (105 CMR 410.000) may face a criminal fine upon conviction. The fine ranges from $10 to $500, and each day of continued non-compliance is treated as a distinct, separate violation. This means that a prolonged failure to comply can result in multiple fines accumulating over time.

For Property Managers

Property owners and managers subject to an order issued under 105 CMR 410.000 § 410.920 are generally expected to act promptly to bring their properties into compliance with any such order. Because each day of non-compliance constitutes a separate violation, operators who delay corrective action risk compounding fines that can accumulate quickly. Compliant operators typically document their remediation steps and timelines to demonstrate good-faith efforts to satisfy any outstanding orders.

For Tenants

Under 105 Mass. Code Regs. 410.000 § 410.920, tenants living in conditions that violate the Minimum Standards of Fitness for Human Habitation may have recourse if a landlord fails to comply with a corrective order. Tenants can report ongoing non-compliance to their local board of health, which has authority to issue and enforce orders under 105 CMR 410.000. Tenant-rights organizations can also help residents understand available options, including how unaddressed violations may be relevant in other housing proceedings.
